Last updated: 1 October 2026
1. Application
1.1 These Terms and Conditions apply to the provision of Training, Membership and the Site by the Guild of Digital Craft (“the Guild”, “we”, “us”) to the Customer.
1.2 If you are a Consumer, nothing in these terms affects your statutory rights. Where a clause says it applies only to Business Customers, it does not apply to Consumers.
2. Interpretation
In these terms:
- Agreement means the contract between the Guild and the Customer for Training or Membership, made up of these terms and the booking or order.
- Business Day means a day other than a Saturday, Sunday or public holiday in England.
- Business Customer means a Customer acting for the purposes of their trade, business, craft or profession, including an employer booking for staff.
- Charges means the prices payable for Training or Membership, as shown on the Site at the time of booking or on our invoice.
- Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
- Customer means the person or organisation who books Training, buys Membership or holds an account on the Site.
- Customer Data means the data, including any images, video and other content, provided by the Customer to the Guild.
- Data Protection Legislation means the UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 and any other applicable data protection law.
- Delegate means the person who attends Training.
- Membership means the paid yearly Guild membership described on the Site.
- Online Booking Process means booking and paying through the Site.
- Proposal means a written quotation or proposal issued by the Guild.
- Site means guildofdigitalcraft.com.
- Training means the courses, classes and sessions provided by the Guild, whether in person or online.
- Training Materials means any notes, files, recordings, project files and other material provided as part of Training.
3. Basis of these terms
3.1 These terms become binding when the Customer completes the Online Booking Process, buys Membership, pays an invoice from the Guild, or signs a Proposal.
3.2 Any descriptive matter or advertising issued by the Guild is issued for the sole purpose of giving an approximate idea of the Training described in it and does not form part of these terms.
3.3 These terms apply to the exclusion of any other terms that a Business Customer seeks to impose or incorporate.
3.4 A Proposal is valid for acceptance for 30 calendar days from its date of issue.
4. Supply of training
4.1 The Guild will use reasonable care and skill to supply the Training in accordance with these terms in all material respects. We may update course content to keep it current, provided the Training remains materially the same as described.
4.2 Any dates shown for Training are our planned dates. If we need to change a date, we will tell you as soon as we can.
4.3 We may change these terms or the Training to comply with any applicable law, where the change does not materially affect the nature or quality of the Training.
4.4 We may need to cancel or reschedule Training, for example if too few people book or a tutor is unavailable. If we do, we will offer you a choice of an alternative date, a credit note or a full refund of the Charges paid for that Training.
5. Your obligations
5.1 The Customer shall:
- co-operate with the Guild in all matters relating to the Training;
- provide accurate information about themselves and any Delegates; and
- where Training is delivered at the Customer’s premises, provide suitable space and equipment.
5.2 You are responsible for keeping your password confidential and for activity on your account.
5.3 When using the Site you agree not to:
- systematically retrieve data or content from the Site to build a collection or database without our written permission;
- trick, defraud or mislead the Guild or other users;
- circumvent, disable or interfere with security features of the Site;
- use information obtained from the Site to harass, abuse or harm another person, or to send unsolicited email;
- make improper use of our support services or submit false reports;
- use the Site in a way that breaks any applicable law or regulation;
- upload viruses or other material that interferes with anyone’s use of the Site;
- use robots, scrapers or other automated systems to access the Site, except standard search engines;
- delete copyright or other proprietary notices from any content;
- impersonate another person or create an account under false details;
- interfere with, disrupt or place an unreasonable load on the Site;
- harass, intimidate or threaten our tutors, staff or other members;
- copy, decompile or reverse engineer any of the Site’s software, except as the law allows; or
- use the Site to compete with the Guild.
6. Charges and payment
6.1 Charges are per Delegate per course unless stated otherwise, and are shown in pounds sterling. Prices shown include VAT where applicable.
6.2 For online bookings, the Charges are paid in full at checkout through the Online Booking Process. Where the Guild issues an invoice, the Customer shall pay it within 30 calendar days of the invoice date, and in any event before the Training starts.
6.3 If payment is not received when due, the Guild may withdraw the Delegate’s place, stop providing the Training, and withhold any certificate.
6.4 Business Customers only: if an invoice is overdue, the Business Customer shall pay interest on the overdue sum from the due date until payment, at 2% a year above the Bank of England’s base rate from time to time, accruing daily.
6.5 All payments shall be made in full without any set-off, counterclaim, deduction or withholding, except any deduction of tax required by law.
7. Cancelling a course
7.1 Your 14-day right to cancel (Consumers). Under the Consumer Contracts Regulations 2013, a Consumer may cancel a booking within 14 days of making it, for a full refund. If you book a course that starts within those 14 days, you ask us to provide the Training within the cancellation period: if you then cancel before it starts you still receive a full refund, but once the course has started or been completed the right to cancel no longer applies.
7.2 After the 14-day period, a booking may be cancelled up to 30 calendar days before the course start date for a full refund. Cancellations within 30 days of the start date are not refundable, but we will try to transfer your place to another date where one is available.
7.3 You may send someone else in your place at no charge if you let us know before the course starts.
7.4 Cancellations must be made in writing through our contact page. A Delegate who does not attend is not entitled to a refund.
7.5 Refunds are made to the original method of payment.
8. Guild membership
8.1 Membership is a yearly subscription that renews automatically at the end of each year at the price shown on the Site at the time of renewal. We will tell you in advance if the price changes.
8.2 You can cancel at any time from your dashboard. Your membership then stays active until the end of the year you have paid for and does not renew. After that, your portfolio shows only as many works as a free account allows (your newest ones). The rest are kept, not deleted, and go back on show if you rejoin.
8.3 Consumers may cancel a new membership within 14 days of joining for a full refund by contacting us. By joining you ask us to make the membership available immediately; if you have already used member features, such as showing more portfolio work than a free account allows, we may deduct a proportionate amount for the time you were a member.
8.4 Apart from clause 8.3, membership fees already paid are not refundable for part of a year.
8.5 We may suspend or end a membership or account if you seriously or repeatedly breach these terms, and will refund any unused part of the membership fee unless the breach involved fraud or abuse of others.
9. Your content and public profiles
9.1 You keep ownership of everything you upload to the Site, including your profile, images, videos and portfolio work.
9.2 You grant the Guild a non-exclusive, royalty-free, worldwide licence to host, display and reproduce that content on the Site, including in the public work gallery and on the homepage, and in posts promoting the Guild with credit to you. This licence ends when you remove the content, except for copies already shared in posts.
9.3 You confirm that you own, or have permission to use, everything you upload, and that it is not unlawful, offensive or infringing. We may remove content that breaks these terms.
9.4 Profiles and published work are public unless you hide your profile. How we handle personal information is explained in our privacy policy.
10. Intellectual property
10.1 All intellectual property rights in the Training and Training Materials belong to the Guild or its licensors.
10.2 Training Materials are for the Delegate’s personal learning. No reproductions, scans or copies, in whole or part, may be made or shared without our prior written consent. Work that you create during a course belongs to you.
11. Customer data and data protection
11.1 As between the parties, the Customer owns all rights in the Customer Data.
11.2 The Customer grants the Guild a licence to use the Customer Data as needed to provide the Training, Membership and Site.
11.3 Each party shall comply with the Data Protection Legislation. Where a Business Customer provides personal data about its Delegates, it confirms that it has the right to share that data with us for the purpose of the Training. Our privacy policy explains how we use personal data.
12. Limitation of liability
12.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
12.2 Consumers: we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for any business losses.
12.3 Business Customers: subject to clause 12.1,
- the Guild shall not be liable, whether in tort (including negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise, for any loss of profits, loss of business, loss of income, depletion of goodwill, loss or corruption of data, pure economic loss, or any special, indirect or consequential loss, however arising; and
- the Guild’s total liability shall be limited to the total Charges paid for the Training or Membership in question.
12.4 For Business Customers, the terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Agreement.
12.5 This clause 12 survives termination of the Agreement.
13. Confidentiality
13.1 Each party shall keep confidential any confidential information about the other party’s business disclosed in connection with the Agreement, and use it only to carry out the Agreement, except where disclosure is required by law, a regulator or a court. This does not apply to information that is public (other than through a breach of this clause), already lawfully held by the receiving party, lawfully received from a third party, or independently developed.
13.2 The Guild may use anonymised information about bookings and courses, for example in reports, without restriction.
13.3 This clause 13 survives termination of the Agreement.
14. Termination
14.1 Either party may end the Agreement with immediate effect by written notice if the other party commits a material breach that cannot be remedied or is not remedied within 30 calendar days of written notice, or (for Business Customers) becomes insolvent or ceases to carry on business.
14.2 The Guild may end the Agreement with immediate effect by written notice if the Customer fails to pay any amount when due.
14.3 Ending the Agreement does not affect any rights, remedies, obligations or liabilities that have built up by then. Clauses intended to continue after termination remain in force.
15. Events outside our control
The Guild is not liable for any failure or delay in performing its obligations caused by events beyond its reasonable control, including strikes, failure of a utility, transport or telecommunications network, illness of a tutor, act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, accident, breakdown of equipment, fire, flood, storm or default of suppliers. If such an event affects your Training, we will contact you and offer a new date, a credit note or a refund.
16. General
16.1 Variation. Subject to clause 4.3, no variation of an Agreement is effective unless agreed in writing, including by email.
16.2 Waiver. A failure or delay in exercising any right or remedy does not waive that or any other right or remedy.
16.3 Severance. If any provision is found invalid, illegal or unenforceable, it is deemed deleted, and the rest of the Agreement remains in force.
16.4 Entire agreement. For Business Customers, the Agreement is the entire agreement between the parties and supersedes all previous agreements and understandings relating to its subject matter.
16.5 Assignment. The Customer may not transfer its rights or obligations under the Agreement without our written consent. The Guild may transfer its rights and obligations to another organisation, and will make sure this does not reduce your rights.
16.6 No partnership. Nothing in the Agreement creates a partnership or agency between the parties.
16.7 Third-party rights. No one other than the parties has any right to enforce the Agreement under the Contracts (Rights of Third Parties) Act 1999.
16.8 Notices. Notices must be in writing. We will send notices to the email address on your account; you can send them to us through our contact page. An email is treated as received when it is sent.
17. Governing law and jurisdiction
17.1 These terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by the law of England and Wales.
17.2 The courts of England and Wales have exclusive jurisdiction, except that if you are a Consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts.
